DECISIONS OF THE GENERAL ASSEMBLY OF THE JUDICIARY REGARDING THE REASONS FOR DIVORCE
JUDICIARY HGK – 2020/62 K., 2017/2-1934 E., 23.01.2020 T.
"... In order to ask for divorce, it is not necessary to be completely flawless or slightly flawed, and even the party who is more flawed has the right to sue, but the existence and determination of the defendant's fault, even if it is small, is inevitable in order to decide on divorce."
JUDICIARY HGK – 2020/333 K., 2017/2-2651 E., 03.06.2020 T.
"... The plaintiff-merging defendant's meeting with the defendant-merging plaintiff upon the defendant-merging plaintiff's statement that he would not perform the marriage is an attempt to reconcile, and since it is understood that the parties did not reconcile after this attempt, nor did they live together, the characterization of this action of the plaintiff-merging defendant as forgiveness is not in accordance with the nature of the concrete case."
JUDICIARY HGK – 2020/505 K., 2017/2-2440 E., 01.07.2020 T.
"... It is necessary to dismiss the case since it has not been proved that the marriage union continued after some of the events in the statements of the plaintiff witnesses, the events that were forgiven or tolerated cannot be taken into account in the fault determination, in this case, the defendant has not proven a defective behavior that would cause divorce, and it is not fixed that the marriage union has been shaken from its foundations to a degree that cannot be expected from the spouses to maintain a common life."
JUDICIARY HGK – 2020/799 K., 2017/2-2487 E., 21.10.2020 T.
"... The defendant is at fault in the events that led to the divorce with his actions in the form of "insult" and "physical violence" due to the nail mark fixed with the report dated 01.08.2014 belonging to the plaintiff spouse, and as such, the conditions for deciding on divorce have occurred."
JUDICIARY HGK – 2020/987 K., 2017/2709 E., 02.12.2020 T.
"... In the events that led to the divorce, it is seen that the male spouse exhibited ongoing insults, physical violence and negligent behavior neglecting the duties of the union, whereas the female spouse acted against the obligation of fidelity and as a result, the male spouse's right to personality and the female spouse's right to life were violated in the marriage union that actually ended with the stabbing of the female spouse in the back in a life-threatening way. When all these issues are evaluated together; the parties should be considered at least equally at fault in the events leading to divorce."
